These General Terms and Conditions (“Terms”) govern all sales made through bynecessities.be (the “Website”). The Website is operated by:

By placing an order on the Website, you confirm that you have read, understood, and accepted these Terms. If you do not agree, please do not use the Website.

2. Who can order

You can place an order on the Website if you are:

  • At least 18 years old, or have the consent of a parent or legal guardian
  • Acting in a personal capacity (consumer) or on behalf of a business (B2B)
  • Providing accurate and current contact and billing information

We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, error in pricing or stock, or violation of these Terms.

3. Products and pricing

We make every effort to display our products accurately, including descriptions, images, ingredients, and prices. However:

  • Product images are illustrative; the actual product may vary slightly in color or packaging
  • Prices are displayed in euros (€) and include 21% Belgian VAT unless otherwise indicated
  • Prices do not include shipping costs, which are calculated at checkout based on destination and order value
  • We reserve the right to correct pricing errors before order confirmation; if a clear error is identified after order placement, we will contact you with the option to confirm at the correct price or cancel

4. Placing an order

Your order is placed when you complete the checkout process and receive an order confirmation email. The contract of sale is formed at that moment.

If you do not receive a confirmation email within a reasonable time, please check your spam folder before contacting us.

5. Payment

We accept the following payment methods, processed securely by Mollie:

  • Bancontact
  • iDEAL
  • Visa / Mastercard
  • Belfius Pay Button
  • KBC/CBC Payment Button
  • Other methods as displayed at checkout

Full payment must be received before your order is processed and shipped. We do not store payment card details on our servers.

6. Shipping and delivery

  • Orders are shipped to addresses within Belgium, the European Union, and selected non-EU countries as listed at checkout
  • Delivery times are estimates and not guaranteed; typical delivery within Belgium is 2-5 business days
  • Shipping costs depend on destination and order value; free shipping thresholds apply per zone and are shown at checkout
  • Risk of loss or damage passes to you upon delivery
  • If your package is damaged in transit, please contact us within 7 days of receipt with photographs

7. Right of withdrawal (consumers only)

If you are a consumer (purchasing for personal, non-commercial use), you have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason, in accordance with Book VI of the Belgian Code of Economic Law.

Exceptions: the right of withdrawal does not apply to:

  • Sealed cosmetic or hygiene products that have been opened or unsealed after delivery
  • Products made to your specifications or clearly personalized
  • Products that have been tested or used beyond what is necessary to assess them

8. Warranties

All products sold on the Website are covered by the legal warranty of conformity under Belgian law, applicable for consumers for 24 months from delivery. If a product is defective, not as described, or not fit for purpose, please contact us within a reasonable period after discovering the defect.

This warranty does not cover damage caused by normal wear, misuse, or failure to follow product instructions.

9. Liability

To the extent permitted by law, our total liability for any claim arising from your purchase is limited to the value of the order in question. We are not liable for indirect, incidental, or consequential damages.

Nothing in these Terms limits or excludes liability that cannot legally be excluded, such as liability for fraud, gross negligence, or death/personal injury caused by negligence.

10. Intellectual property

All content on the Website — including text, images, logos, product descriptions, and design — is the property of Necessities or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or use this content commercially without our written permission.

11. Personal data

We process personal data in accordance with our Privacy Policy and the GDPR.

12. Applicable law and disputes

These Terms are governed by Belgian law. Any dispute arising from a purchase made on the Website will be submitted to the competent courts of Antwerp, Belgium, unless mandatory consumer protection law assigns jurisdiction elsewhere.

Before initiating legal proceedings, we encourage you to contact us at info@necessities-antwerp.be to seek an amicable resolution.

Consumers may also use the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr or contact the Belgian Consumer Mediation Service (Consumentenombudsdienst).

13. Changes to these Terms

We may update these Terms from time to time. The version applicable to your order is the one in force at the time of order placement.
